03-25-2024 WDE Seeks Public Comment For State IDEA Application

Each year, the Wyoming Department of Education submits a state application under the Part B Individuals with Disabilities Education Act (IDEA), as amended in 2004 Federal Special Education Funds. The agency is seeking public comment on that application through April 22.

The state is required to provide assurances of in-effect policies and procedures that meet all eligibility requirements of Part B of the Act as found in PL 108-446, the IDEA and applicable regulations. If the state cannot provide the assurances outlined, it must provide a date when revision will be made to bring state policies and procedures in line with federal regulations.

The application includes a separate spreadsheet detailing:

  • How amounts retained under section 20 U.S.C. 1411(e) for State administration and State-level activities will be used to meet the requirements of Part B.
  • Specifically, how those amounts will be allocated among the state-level activities described in 20 U.S.C. 1411(e)(1) and (2) to meet state priorities based on input from Local Education Agencies (LEAs).
  • Dollar amounts, if any, to be distributed to LEAs by formula.
