Proposed rules implementing SEA 43, the 2026 Wyoming Language and Literacy Act, will be reopened for additional public comment based on substantive changes. Chief among those changes is the request by numerous stakeholders to move from a locally defined to a state-defined definition of grade-level reading proficiency. Other comments included a request for a specific, fixed-in-time list of approved screeners, assessments, and instructional materials instead of an ongoing evaluative process. These comments are appreciated and will result in a better set of rules.

The Notice of Intent to promulgate the new proposed rules will be submitted to the Governor on Friday, October 23rd. The Governor has up to 10 days to approve, which allows the Department to release for public comment. The public comment period will be 45 days.
