Wyoming’s IDEA Determination under Section 616(d) of the Individuals with Disabilities Education Act: Part B

Each year the United States Department of Education (USDOE) makes a determination for each state under Section 616(d) of the IDEA regarding the state’s implementation of the statute and federal regulations. In making each state’s determination, USDOE considers the following: the state’s most recent Annual Performance Report (APR) submission, information from monitoring visits (including verification reviews) and other public information, such as the state’s performance under any existing special conditions on its federal grant or a compliance agreement, longstanding unresolved audit findings, and other State compliance data under the IDEA. Part B State Performance Plan (SPP) and Annual Performance Report (APR) determination letters for Wyoming are posted on the USDOE’s website.

Annual School District Determinations under IDEA

Under federal regulation, the WDE is also required to annually place each Wyoming school district into one of four determination categories, based on each district’s performance on both compliance and performance indicators of the SPP. IDEA specifies four determination categories, which are:

  • Meets Requirements
  • Needs Assistance
  • Needs Intervention
  • Needs Substantial Intervention

Wyoming’s Chapter 7 Rules specify a variety of district sanctions and incentives based on each district’s determination level, and the length of time the district has remained in a single category. Each year, these determination results greatly inform the WDE’s special education professional development and technical assistance efforts.
