Wyoming’s State Part B IDEA Determinations under IDEA

Each year the United States Department of Education (USDE) Office of Special Education Programs (OSEP) makes a determination for each state under Section 616(d) of the IDEA regarding the state’s implementation of IDEA and federal special education regulations. In making each state’s determination, USDE considers the following: 

  • the state’s most recent Annual Performance Report (APR) submission
  • information from monitoring visits (including verification reviews) and other public information
  • longstanding unresolved audit findings
  • other State compliance data under the IDEA. 

Wyoming’s Part B State Performance Plan (SPP) and Annual Performance Report (APR) determination letters are posted on the USDE Part B SPP Letters and APR Letters website.

Annual District and EIEP Part B Determinations under IDEA

Under federal regulation, the WDE is required to annually place each Wyoming school district and the Early Intervention Education Program (EIEP) into one of the following four determination categories based on district or EIEP performance on both compliance and performance indicators of the State Performance Plan (SPP):

  • Meets Requirements
  • Needs Assistance
  • Needs Intervention
  • Needs Substantial Intervention

Wyoming’s Wyoming Chapter 7 Rules Section 9 specifies a variety of district sanctions and incentives based on each district’s or the EIEP’s determination level, and the length of time the district has remained in a single category. Each year, these determination results inform the WDE Special Education Program division’s professional development and technical assistance efforts.
